In the case of works for hire, the employer or other person for whom the work was prepared is considered the author and copyright owner, unless other arrangements are made by the parties in a signed written agreement

CAPITOLUL I, Subiectul dreptului de autor

Art. 3. -(1) Este autor persoana fizica sau persoanele fizice care au creat opera.

(2) In cazurile expres prevazute de lege, pot beneficia de protectia acordata autorului persoanele juridice si persoanele fizice altele decat autorul.
(3) Calitatea de subiect al dreptului de autor se poate transmite in conditiile legii.

Art. 4. – (1) Se prezuma a fi autor, pana la proba contrara, persoana sub numele careia opera a fost adusa pentru prima data la cunostinta publica.

Autor anonim, autori cu pseudonim

(2) Cand opera a fost adusa la cunostinta publica sub forma anonima sau sub un pseudonim care nu permite identificarea autorului, dreptul de autor se exercita de catre persoana fizica sau juridica ce o face publica numai cu consimtamantul autorului, atat timp cat acesta nu-si dezvaluie identitatea.

Coautori si colaboratori

Art. 5. – (1) Este opera comuna opera creata de mai multi coautori, in colaborare.
(2) Dreptul de autor asupra operei comune apartine coautorilor acesteia, intre care unul poate fi autorul principal, in conditiile prezentei legi.
(3) In lipsa unei conventii contrare, coautorii nu pot utiliza opera decat de comun acord. Refuzul consimtamantului din partea oricaruia dintre coautori trebuie sa fie temeinic justificat.
(4) In cazul in care contributia fiecarui coautor este distincta, aceasta poate fi utilizata separat, cu conditia sa nu se prejudicieze utilizarea operei comune sau drepturile celorlalti coautori.
(5) In cazul utilizarii operei create in colaborare, remuneratia se cuvine coautorilor in proportiile pe care acestia le-au convenit. In lipsa unei conventii, remuneratia se imparte proportional cu partile de contributie ale autorilor sau in mod egal, daca acestea nu se pot stabili.
Art. 6. – (1) Este opera colectiva opera in care contributiile personale ale coautorilor formeaza un tot, fara a fi posibil, data fiind natura operei, sa se atribuie un drept distinct vreunuia dintre coautori asupra ansamblului operei create.
(2) In lipsa unei conventii contrare, dreptul de autor asupra operei colective apartine persoanei fizice sau juridice din initiativa, sub responsabilitatea si sub numele careia a fost creata.

For the purpose of library cataloging, the act of having created the intellectual content of a work, in writing or any other medium of expression, usually indicated by the name of the personal or corporate author in or on the chief source of information used by catalogers in describing the item. In AACR2, authorship is given in the statement of responsibility in the title and statement of responsibility area of the bibliographic record. Authorship is interpreted in the broad sense of having written, edited, compiled, composed, adapted, translated, etc., the work. If authorship cannot be determined with certainty, a work is said to be of unknown authorship and is cataloged under the title. A creative work is the intellectual property of the author and in most countries, the author’s rights in the work are legally protected by copyright.

In AACR2, the portion of the bibliographic description indicating by name the person(s) responsible for creating the intellectual or artistic content of the item (author, editor, compiler, composer, arranger, etc.), the corporate body from which the content emanates, or the person(s) or corporate body responsible for performing the content. In most cases, the statement of responsibility is transcribed from the chief source of information for the item. When more than one kind of responsibility is indicated (multiple statements of responsibility), the names are transcribed in the order in which they appear on the chief source of information.

Editori

editor

A person who prepares for publication the work(s) of one or more other authors. An editor may be responsible for selecting material included in a collection or for preparing manuscript copy for the printer, including annotation of the text, verification of the accuracy of facts and bibliographic citations, polishing grammar and style, organizing front and back matter, etc. Periodicals and large reference works often have a general editor or editor-in-chief who supervises the work of an editorial staff. In large publishing houses, the editing process may be divided into separate functions, each performed by a different person:

Acquisition editor – scouts and evaluates new works for recommendation to the publisher

Manuscript editor – assists the author in developing and organizing the work

Copy editor – perfects details of grammar and style, checks the accuracy of facts, quotations, citations, etc.

Managing editor – coordinates resources required for publication and develops the publication schedule

Production editor – oversees the transition from editorial process to production (printing, binding, distribution)

Also refers to the individual in charge of the content of a newspaper, magazine, or journal, and in some cases its publication, whose name is given in the masthead. See also: editorial, editorial board, and letter to the editor.
